SAG-AFTRA's Strike Against Video Game Giants: A Fight for AI Protections
SAG-AFTRA, the actors' and broadcasters' union, launched a strike against major video game companies on July 26th, 2024, targeting industry leaders such as Activision, Electronic Arts, and others. This action, following prolonged and unsuccessful negotiations, centers on critical concerns regarding the ethical use of artificial intelligence (AI) and fair compensation for performers.
The Core Issues: AI and Fair Compensation
The union's primary concern revolves around the unregulated use of AI in the video game industry. While not inherently opposed to AI technology, SAG-AFTRA fears its potential to displace human actors. Specific anxieties include the unauthorized replication of actors' voices and likenesses, and the possibility of AI assuming smaller roles, thereby limiting opportunities for aspiring performers. Furthermore, the union raises ethical questions surrounding AI-generated content that might contradict an actor's personal values.
Bridging the Gap: Interim Agreements and Solutions
In response to the challenges, SAG-AFTRA has proactively introduced several agreements to address the situation. The Tiered-Budget Independent Interactive Media Agreement (I-IMA) offers a flexible framework for smaller-budget projects ($250,000-$30 million), providing tiered rates and terms that accommodate projects ineligible under traditional contracts. This agreement, established in February, incorporates crucial AI protections previously rejected by the video game industry's bargaining group. A parallel agreement with Replica Studios allows union actors to license digital voice replicas under strict terms, including the right to opt out of perpetual usage.
Additionally, the Interim Interactive Media Agreement and the Interim Interactive Localization Agreement provide temporary solutions covering various aspects, including compensation, AI usage stipulations, rest periods, and other crucial employment conditions. Importantly, these agreements exclude post-release content such as expansion packs and DLC, thereby providing avenues for continued work during the strike.
A Timeline of Resistance and Unwavering Resolve
Negotiations commenced in October 2022, culminating in a near-unanimous (98.32%) strike authorization vote among SAG-AFTRA members on September 24, 2023. Despite some progress on other issues, the lack of concrete and enforceable AI protections remains the primary obstacle. Union leadership, including President Fran Drescher and National Executive Director Duncan Crabtree-Ireland, have emphasized the industry's substantial profits and the vital contribution of SAG-AFTRA members, underscoring the union's resolve to secure fair treatment and robust AI safeguards. The union's commitment to equitable AI practices is unwavering, and they intend to secure these protections for their members. The strike continues as SAG-AFTRA actively seeks a resolution that safeguards the rights and livelihoods of its members in the evolving landscape of video game development.
